Saddlebredsforsale.com (the “Site” or “Saddlebreds”) appreciates that you care about how information about you is used and shared. This Privacy Policy describes the privacy policy of saddlebredsforsale.com, owned and operated by Horse Lingo, LLC (“Horse Lingo”), an Illinois limited liability company, its members, officers, agents, employees, successors, and assigns (referred to hereafter as “we” or “us”). By accessing or otherwise using the Site, you agree to the terms and conditions of this Privacy Policy and of the associated Terms of Use. If you do not agree, or are legally unable to agree, to the terms and conditions, exit this page and do not access or use the Site.

1. Updates to Privacy Policy. We may update or change this Privacy Policy from time to time by posting the revised Privacy Policy on the Site. The revised Privacy Policy is effective immediately upon posting. You agree to be bound by any such revisions. You should periodically visit this page to determine the current terms of our Privacy Policy.

2. Types of Information Gathered by Horse Lingo. The information we gather about users of this Site enables us to provide, personalize, and continually improve our services. Here are the types of information we gather:
Information You Give Us:  We receive and store any information you enter on the Site or provide us in any way. For example, you provide us with information when you complete a Saddlebreds subscriber or listing form, ask us for information, or interact with the Site in other ways. We may ask you to provide us with certain personally identifiable information. Some of the information we ask you to provide us is mandatory and some is voluntary. If you do not provide the mandatory information requested for a particular activity, you will not be permitted to participate in that activity.
Automatic Information:  We receive, analyze, and store certain types of information whenever you interact with the Site whether or not you are a Saddlebreds Advertiser or subscriber. For example, we collect your login and email address; information about your browser and operating system; and the Uniform Resource Locators (URLs) of the websites you visited before and after our Site. We may also place cookies on your computer to prevent fraud and to personalize your experience on our Site. A cookie is a small piece of information that a website can send to your browser and may then be stored on your computer’s hard drive. You may be able to block, delete, or disable such cookies, but doing so may prevent you from taking advantage of some or all Horse Lingo services. We additionally may use software tools, such as web beacons, to collect information about how users move about and use our Site to improve our services.
Information on Facebook^®, Instagram^®, and Other Social Media. If you link through, to, or otherwise interact with our Site through our Facebook, Instagram, or other social media accounts, you also may provide us with information from or accessible through any social media account you have on the same platform.
Information from Other Sources:  We may combine information you provide us with information from third parties to correct our records or enhance our services. This may include, but is not limited to, information from horse shows or third parties that provide horse sales or breeding data.

3. How Horse Lingo Shares the Information It Receives. Information about our users is an integral part of our business. We may share your information with others in the following ways:
With Social Media Sites:  If you are a Saddlebreds Advertiser, we may share the personally identifiable information that you provide us via the Saddlebreds Listing Agreement, form, emails, and professional photographers or videographers (“Content”) with Facebook^®, Twitter^®, YouTube^®, Pinterest^®, and possibly other social media platforms, depending on the specific services you have contracted with us to provide. This Content will be available for others to read, view, comment on, or analyze. We have no control over who reads, views, comments on, or analyzes the Content you voluntarily give us. You agree not to provide us with Content that is illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties. When you provide us with Content, you grant Horse Lingo a nonexclusive, royalty-free, perpetual, and irrevocable right to use, reproduce, adapt, publish, or distribute such Content and to use your name in conjunction with the Content alone or as part of other works in any form, media, or technology whether now known or hereafter developed and to sublicense such rights. If you directly post a comment or other information on any of the social media sites that we use to provide our services, any information that you post may be shared with other users. Both the Content that we post and the information that you post are subject to the social media sites’ privacy policies, which you can access on their websites.
With Authorized Third-Party Service Providers:  We employ other companies and individuals to perform functions on our behalf, such as analyzing data, providing marketing assistance, and operating or hosting our Site, and we may share your personally identifiable information with these parties. We encourage our third-party service providers to adopt and post privacy policies; however, the use of your personally identifiable information by such parties is subject to their privacy policies and is not subject to our control.
With Other Third Parties and Linked Websites:  Our Site may contain third-party advertisements that include links to third-party websites. We may share aggregated, non-personally identifiable information with these third-party advertisers. When you access a third-party website via this Site, the third-party website may send its content directly to your browser or use cookies and other technology to measure the effectiveness of or personalize its content and links. We do not have access to and cannot control technology used by these third parties and linked websites, and their information practices are not covered by this Privacy Policy. We encourage you to contact them directly to review their privacy policies. You may obtain information about Internet advertising companies, including how to opt out of their information collection, by contacting the Networking Advertising Initiative at https://www.networkadvertising.org/.
To Parent or Affiliated Companies:  While we currently do not have a parent company, subsidiaries, or any other companies under a common control, we may in the future, and we may share your personally identifiable information with these companies, in which case we will require them to honor this Privacy Policy.
In a Change of Ownership:  As we continue to develop our business, we might merge with or be acquired by another company. If this happens, the successor company could acquire the information we maintain, but personally identifiable information would remain subject to this Privacy Policy.
For Horse Lingo’s Protection or the Protection of Others:  We may disclose your personally identifiable information if we believe in good faith that such disclosure is necessary to comply with the law or a court order; enforce our Terms of Use, Listing Agreement, or other agreements; protect the rights, property, or safety of Horse Lingo, our users, or others; to address financial fraud or any type of illegal activities directly affecting us; or for purposes of collecting any money owed to us by you.

4. Security of Your Credit Card Information. To protect the security of your credit card information, we currently use QuickBooks Payments/Merchant Services Center. We do not have access to your credit card information when you share it directly with QuickBooks Payments/Merchant Services to become a Saddlebreds Advertiser or pay for other Horse Lingo services. The use of your personally identifiable information by QuickBooks Payments/Merchant Services Center is subject to its privacy policy and is not subject to our control. Its privacy policy is available at https://www.intuit.com/privacy/protect-your-privacy/. It is also important for you to protect against unauthorized access to your computer and to sign off when you finish using a shared computer.

5. Managing Your Information. You have options for managing your personally identifiable information on our Site:
-You can add to, update, or delete certain information after you become a Saddlebreds Advertiser subject to the Listing Agreement you have signed with us. When you update information, we may electronically store the prior versions of your information.
-We will not send you third party promotional emails without your permission, but we cannot control what the social media sites that we use send to you or sell to others. As a condition of becoming a Saddlebreds Advertiser, however, you agree to receive from us administrative emails related to your advertising activity and announcements about new features we offer. We may also send you newsletters via email, although you may later opt out of receiving the emailed newsletters.
-If you no longer want to be a Saddlebreds Advertiser, you may terminate the Listing Agreement consistent with the terms of that Agreement. If you do so, we will no longer send you email about new features; however, your Content may remain in our historical records, and we cannot delete Content that may be stored by the social media sites we use.
-Please note that, because there is no consistent industry understanding of how to respond to “Do Not Track” signals, we do not alter our data collection and usage practices when we detect such a signal from your browser.

6. Children’s Privacy Issues. Minors under the age of 13 may not use the Site. We do not knowingly collect or maintain information from anyone under the age of 13. If we collect information about or images of someone under the age of 13, we do so only with written parental consent. If you are aware of any instance where we have collected such information without parental consent, please inform us immediately. If you are the parent of a child under the age of 13 whose information or image we have collected and used as part of our Services, you have the right to ask us to remove and delete that information by emailing us at horselingo@gmail.com. Minors under the age of 18 may use the Site with the consent of a parent or legal guardian but may not become a Saddlebreds Advertiser.

7. GDPR and State Laws. If you are in a country that is governed by the European Union General Data Privacy Protection Regulation (“GDPR”) or a state that has adopted data privacy protection regulations, such as California, Colorado, Virginia, Massachusetts, New York, Hawaii, and North Dakota, then some or all of the following may be applicable to you.

To the extent GDPR regulations regarding the processing of your personal data (“Personal Data”) apply to us, under certain circumstances we may be considered a “data controller.” Personal Data includes your name, address, email address, telephone number, credit card information, and geolocation, some of which we may collect and process and some of which may be collected and processed by third parties. These third parties may be considered “data controllers” in their own right, and you should review their privacy policies.

We process your Personal Data only as necessary to offer and provide products and services to Users within the United States of America (“United States”). Our legal basis for processing your Personal Data includes:
-Complying with legal requirements.
-Managing and improving our website and our relationship with you.
-Providing you with information about our products and offerings.

We will retain your Personal Data only for so long as reasonably necessary to fulfill your order, offer additional services to you, and understand how to improve our services. We also retain your Personal Data for the time necessary to meet legal requirements and any applicable statute of limitations. Because we are in the United States, your Personal Data for which we may be considered the data controller will be transferred to the United States.

Depending upon the laws applicable to you, the following rights may apply:
-You have the right to object to our processing your Personal Data and, upon receiving such notice, we will stop processing your data, which may mean we cannot provide products or services to you. For example, without your Personal Data we will not be able to sell or ship product to you.
-You may restrict our processing your Personal Data.
-You may ask to update your Personal Data on a going-forward basis.
-You may request a copy of your Personal Data that we have stored and maintained.
-You may request that your Personal Data be deleted, but some Personal Data may not be deleted for legitimate legal reasons.
-You may request that your Personal Data be transferred to another party.

8. Changes to This Privacy Policy. We reserve the right to modify this Privacy Policy at any time. Changes will take effect immediately upon posting, so please review this policy whenever you visit this Site. We will note the date of the last update at the top of the policy. If we make material changes to the policy and you are an active Saddlebreds Advertiser or subscribe to our emails, we will notify you by email about the change.

9. Dispute Resolution. The parties agree that this Privacy Policy shall be interpreted under the laws of the State of Illinois without reference to its conflict of laws provisions. The parties agree that, as to any dispute arising out of or relating to this Privacy Policy, they shall submit such dispute to an impartial mediator for resolution. If the parties are unable to resolve the dispute by mediation, then the parties may bring an action in a court located in Will County, Illinois or, if a federal action, in the Northern District of Illinois. The parties hereby consent and agree to submit to the jurisdiction of and venue in such courts and waive any argument of inconvenient forum.
